What is a Deed of Variation Plan?
In cases where there has been a change to the physical layout of a leasehold flat, or where the demise has been extended, a deed of variation may be needed.
The Deed of Variation will include an amended Land Registry compliant plan which will be registered at the Land Registry.
It is advisable to obtain a deed of variation if carrying out changes to a leasehold property, as you may experience difficulties at the point you decide to sell the leasehold.
Common reasons a Deed of Variation may be needed
- Where a lease plan doesn’t accurately reflect the demise of a leasehold.
- Where there has been an extension to the boundary of the building.
- Where a flat has extended into a loft space.
Tip: If you make changes to a leasehold flat, ensure the plan and lease documentation accurately reflect the demise to avoid issues when selling.
Example: Updating a non-compliant lease plan
In the example below, the original plan that went along with the Lease was not correctly to scale, had no north point, no floor levels, and did not show that the loft was part of the demise of the First Floor Flat.
Therefore, a deed of variation plan was needed. We created a Land Registry compliant plan which showed the flat and the extended demise (the loft).
What the updated plan included
- Plan scaled at 1:100.
- A north point.
- A location plan at 1:1250.
- The demise and common areas shown in colours which corresponded to the lease document.
